MISSION STATEMENT

Reporting to the President and Managing Director of  Moet Hennessy Europe, this is a pan-european role, being the legal expert, advisor, council and leader regarding all legal matters for MH Europe.  Ensuring the business is kept aware of current and future legal topics and issues, with a high level of risk management. 


MAIN RESPONSIBILITIES

>  Anticipates, plans for, is involved in and manages legal matters across MH Europe.

>  Functionally part of MH's Legal function; coordinates and manages all legal matters for MH in Europe. 

>  Corporate Secretary: ensures corporate secretary and compliance are handled with the relevant legal requirements in each Market.  Coordinates with market General Managers, CFOs and local legal advisers when needed.

>  Development and establishment of Distribution Companies (DisCo): Manages the legal set up and creation of new DisCo, and advises on legal matters and business restructuring in coordination with MH and LVMH Legal where appropriate.

>  Distribution Contracts: Coordinates with MH legal and Maisons to prepare / renew contracts with main agents and partners. Ensures management of proper renewals, terminations and documentation including compliance background checks..

>  Competition Law / Anti-Fraud / Money laundering/data Privacy: Acts as the Compliance Officer for MH Europe. Ensures proper training and implementation of MH Europe guidelines including code of conduct, competition law sensitization, data privacy guidelines. Point of contact in case of issues.

>  Anti-trust / Competition Law:  In charge of Anti-Trust and Competition Law matters, service, direction, training and support.

>  Claim Litigation: Guides, facilitates and supports local MDs/ CFOs in case of claim litigation.  Keeps a network of legal advisers in Europe. Ensures that MH Legal is informed ahead of time re. claims and litigations over EUR 300k.

>  Contracts: Takes European lead and ensures that contracts are in line with the local legal framework. Raises Management awareness on key terms.

>  Ad- hoc: Supports MH Europe HQ and markets on any ad-hoc projects, providing legal expertise, guidance and solutions. Supports MH Legal on specific European projects when needed.
 


Profile


QUALIFICATION, EXPERIENCE & SKILLS REQUIRED :


Education: Graduate Law Degree (International business law)

Languages:  English. French and/ or other European language is a plus

Professional experience & know how
>  10-15 years post-qualification experience in handling Corporate/ Commercial/ Competition/Consumer issues
>  Past experience from distribution and competition law
>  Experience from distribution businesses in a regulated context is a plus (pharmaceutical, food product) or FMCG/  consumer businesses. 
>  M&A background is a plus
>  Previous pan-European remit and responsibility
>  Used to working on a senior level
